The controller within the meaning of the General Data Protection Regulation (GDPR) is:
Rechtsanwalt Theo Funk (attorney-at-law)
Troppauplatz 1d, 96052 Bamberg, Germany
Phone: +49 951 16099520
E-mail: office@kanzlei-theofunk.de
2. General information on data processing
As a matter of principle, we process the personal data of our users only to the extent necessary to provide a functioning website as well as our content and services. As a rule, personal data is processed only with the user's consent or where the processing is permitted by statutory provisions.
Legal bases: Art. 6(1)(a) GDPR (consent), Art. 6(1)(b) GDPR (contract / pre-contractual measures), Art. 6(1)(c) GDPR (legal obligation), Art. 6(1)(f) GDPR (legitimate interest).
3. Provision of the website & server log files
Each time our website is accessed, our hosting provider automatically collects information transmitted by your browser (so-called server log files): IP address, date and time of the request, time zone difference to GMT, content of the request (the specific page), access status/HTTP status code, the volume of data transferred in each case, referrer URL, browser type and version, operating system.
Purpose: ensuring a smooth connection setup, convenient use of the website, and system security and stability.
Legal basis: Art. 6(1)(f) GDPR.
Storage period: as a rule 7 days, after which the data is anonymised or erased.
4. Contact form and contact by e-mail
If you contact us via the contact form or by e-mail, the details you provide (first name, last name, e-mail address, company where applicable, subject and message) are stored by us in order to process your enquiry and in case of follow-up questions.
Processor & transfer to a third country (USA): For the contact form we use the service Formspree (Formspree Inc., 251 Little Falls Dr, Wilmington, DE 19808, USA). Your form data is transmitted to Formspree in encrypted form and forwarded from there to us by e-mail. In this process, personal data is transferred to the USA. The transfer takes place on the basis of the EU-U.S. Data Privacy Framework (adequacy decision of the EU Commission of 10 July 2023) as well as your explicit consent pursuant to Art. 49(1)(a) GDPR.
Legal basis: Art. 6(1)(a) GDPR (consent) and Art. 6(1)(b) GDPR (initiation of an attorney-client relationship).
Storage period: your data is erased as soon as it is no longer required for the purpose for which it was collected. Statutory retention obligations (in particular under tax, commercial and professional law) remain unaffected.
Withdrawal: you may withdraw your consent at any time by e-mail to office@kanzlei-theofunk.de.
“Coaching Contract” enquiry form (initial assessment)
Via the enquiry form on the page Coaching Contract Exit we collect, in addition to your name and e-mail address: telephone number (voluntary, for a call-back), the name of the provider or programme, the approximate order of magnitude of the contract sum, how the contract was concluded (e.g. video call, order page), the programme format (predominantly recordings or live sessions), the current status (e.g. ongoing instalments, payment reminder, debt collection), the payment channel, whether you received a withdrawal notice and whether you hold legal expenses insurance, and your brief description of the case.
Purposes: conflict-of-interest check (§ 43a Abs. 4 BRAO — German Federal Lawyers' Act) and a free initial assessment as a pre-contractual measure for the initiation of a mandate.
Legal basis: Art. 6(1)(b) GDPR (pre-contractual measures) as well as your consent to the transfer via Formspree (Art. 6(1)(a), Art. 49(1)(a) GDPR), see above.
No documents via the form: please do not submit any contract documents or other documents via the form. We will request documents after the initial contact via a secure transmission channel.
Storage period: if no mandate comes about, we erase your details no later than six months after the correspondence has ended, unless statutory retention obligations preclude this; the basic data required for the conflict-of-interest check (name, opposing party, date) is retained to the extent required under professional law. If a mandate is granted, the retention periods for client files apply (§ 50 BRAO — German Federal Lawyers' Act).
5. Fonts and external resources
Google Fonts
This website loads fonts from Google Fonts (provider: Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). When a page is accessed, your browser loads the fonts directly from Google servers; in doing so, your IP address is transmitted to Google. Legal basis: Art. 6(1)(f) GDPR (uniform presentation of the content of our website).
Font Awesome & Twemoji
For icons we use Font Awesome (Cloudflare CDN, Cloudflare Inc., USA) and, for flag emojis, the Twemoji Country Flags polyfill (jsDelivr CDN). Here, too, your IP address is transmitted to the respective services when the page is accessed. Legal basis: Art. 6(1)(f) GDPR.
6. Embedded third-party content
Our website links to external sites (e.g. brak.de, the EU ODR platform, LinkedIn). Responsibility for third-party content to which links are provided from our website lies exclusively with the respective operators.
7. Self-assessment tools
Self-check & Digital Twin (regingada.com)
The EU self-check / Digital Twin linked from our home page is a service of Regingada UG (haftungsbeschränkt) — a legally independent company owned by the owner of the law firm — and is operated at www.regingada.com. By following the link you leave our website; the data processing carried out there is governed exclusively by the privacy policy of Regingada UG. Any legal review is carried out separately and exclusively by Kanzlei Theo Funk.
FernUSG quick check (no data transmission)
On the page Coaching Contract Exit, the embedded quick check runs entirely in your browser: your selections are not transmitted to any server, are not stored by us, and are discarded when the page is closed or reloaded. No cookies are set and no local storage is used. The result is an automated, non-binding orientation and does not constitute legal advice.
